French notaires - a sort of conveyancing practitioner and French government tax collector rolled into one. The primary function of a notaire is to ensure (for the French government) that all taxes due concerning the sale and purchase of a property are paid, and that the transaction has been carried out correctly. He is not a French solicitor, although there are avocats who are also notaires but the two roles are very different in France. A Notaire is a French civil law notary (like our notary public) - a public officer working for the French Ministry of Justice. He will also deal with family matters, real-estate deeds and many aspects of business law. He's also a property expert, having access to the databases which contain information regarding property transactions in France. He/ she is thus qualified to value property, conduct transactions and deal with tax, French mortgages (known as hypothèques) and finance matters. All property matters in France must be overseen and conducted by a qualified notaire. Fees charged by the notaire are set down by the French government. Currently, you should allow between 6% & 7.5% of the property value for the notaire's fees. Notaire's fees are only payable by the buyer - when you sell, you pay nothing to the notaire for his fees, although you may well find yourself paying plus-value (see below)! Plus-value is the French equivalent of UK capital gains tax. If you own more than one property in France, or do not live in the property as a fulltime resident (e.g. you own a holidayhome in France) or you buy and sell within a specific timescale (15 years), you will find yourself paying plus-value when you sell. The system has recently been overhauled and is somewhat fairer than it used to be. As a French resident you will pay 26% of the net gain, but only 16% if you are an EU (non-French) resident. There are fairly fixed allowances for deductions and under the new ruling, you do not need to provide proof of expenditure if accepting the default (15% of purchase price) allowance for building work/ money spent on maintenance etc. All plus-value is calculated and collected by the notaire, so it's gone before you even saw it!
